AGREEMENT
THIS AGREEMENT dated this 1st day of January, 2004 between
Jim and Betty Rec residing at 111 Some Address, Houston, TX
and John and Jane Doe residing at 222 Another Address, San Francisco, CA.
The parties acknowledge that John and Jane Doe are the owners of five
(5) pre-zygotes (or frozen embryos) which they agree to transfer to Jim
and Betty Rec. John and Jane Doe represent that they are the sole
owners of the pre-zygotes and are entitled to transfer them.
In consideration for the transfer, Jim and Betty Rec
agrees to pay John and Jane Doe out of pocket expenses for legal fees
associated with this agreement as well as any expense incidental to the
transfer as required by the Rec’s or the Rec’s clinics. Other
than the foregoing, the Rec’s shall have no other financial obligation
to the Doe’s. All financial obligations for the Rec’s to the
Doe’s will be made known to the Rec’s at the time of the actual
transfer of the pre-zygotes. The Doe’s hereby acknowledges that
upon transfer, they will have no ownership rights or claims of any
nature whatsoever over the pre-zygotes. They further acknowledge
that they have no and forgo any and all parental and familial rights,
privileges, and obligations with respect to any child or children which
may result. The Rec’s shall exclusively have all such rights,
privileges and obligations.
The Rec’s acknowledge that they have had the
opportunity to consult with independent legal counsel concerning the
contents of this agreement. Transfer of the pre-zygotes shall
occur on or about May 1st, 2004.
